Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Nexoscale ("we", "our", or "us"), the operator of enCode! (https://encode.nexoscale.com). By creating an account or using any part of the service, you confirm that you are at least 13 years old and have the legal capacity to enter into this agreement.

We reserve the right to modify these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the new Terms.

enCode! is a SaaS platform that enables users to create, configure, deploy and manage Discord bots through an AI-assisted web dashboard. The platform provides:

• AI-powered bot creation and configuration tools
• Bot hosting infrastructure on shared or dedicated containers
• Analytics and monitoring for deployed bots
• A marketplace for sharing and acquiring bot templates
• Subscription-based premium features

Access to enCode! requires authentication via Discord OAuth2. By connecting your Discord account you authorize us to access your Discord user ID, username, avatar, email address and guild list as permitted by Discord's API Terms of Service.

You are responsible for maintaining the security of your account and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms, Discord's Terms of Service, or applicable law.

To host a bot, you must provide a valid Discord Bot Token. By submitting a token you confirm that:

• You are the owner of the Discord Application the token belongs to
• You have the right to use that token on our infrastructure
• The bot complies with Discord's Developer Policy and Terms of Service

Tokens are encrypted at rest using AES-256-GCM and are never exposed after submission. We do not share, sell or use your tokens for any purpose other than running your bot.

You agree not to use enCode! to create, deploy or operate bots that:

• Violate Discord's Terms of Service or Community Guidelines
• Engage in spam, harassment, or unsolicited messaging
• Collect or store personal data without proper consent or legal basis
• Distribute malware, phishing content, or harmful code
• Infringe copyrights, trademarks or intellectual property rights
• Facilitate illegal activities including but not limited to fraud, gambling, or CSAM
• Attempt to circumvent platform rate limits, security controls or billing systems
• Impersonate Discord, Nexoscale or any other entity

Violation of this section may result in immediate termination of your account and all associated bots, without refund.

The AI Bot Builder uses large language models to assist with bot creation. You acknowledge that:

• AI outputs are not guaranteed to be accurate, complete or fit for purpose
• You are responsible for reviewing AI-generated configurations before deploying
• Prompts you submit may be processed by third-party AI providers (currently Anthropic)
• Do not submit sensitive personal data, passwords or secrets in AI prompts

Premium subscriptions are processed through Tebex. By subscribing you agree to Tebex's own terms of service in addition to these Terms.

• Subscriptions auto-renew monthly until cancelled
• Prices are shown in USD and exclude applicable taxes
• Refunds are handled on a case-by-case basis at our discretion
• Downgrading from Premium may result in bots exceeding plan limits being stopped

We reserve the right to change subscription prices with at least 14 days' notice to active subscribers.

We make reasonable efforts to maintain bot availability but do not guarantee any specific uptime SLA on the Free plan. Premium plans benefit from priority infrastructure allocation.

We reserve the right to stop, restart or terminate bot containers that consume excessive resources, exhibit abusive behavior, or violate these Terms.

Bot data (configuration, logs, analytics) is retained for 90 days after a bot is deleted. After that period it is permanently removed from our systems.

The enCode! platform, its design, code and branding are owned by Nexoscale and protected by applicable intellectual property laws.

You retain ownership of all bot configurations and content you create on the platform. By publishing a template to the Marketplace, you grant Nexoscale a non-exclusive, royalty-free license to display and distribute that template to other users.

To the fullest extent permitted by applicable law, Nexoscale shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform, including but not limited to: loss of data, loss of revenue, damage to your Discord servers, or actions taken by bots you operate.

Our total aggregate liability shall not exceed the amount you paid to us in the 3 months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Nexoscale, its directors, employees and partners from and against any claims, damages, losses or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your bots' actions in Discord servers.

You may delete your account at any time from the Settings page. Upon deletion, all your bots will be stopped and your data will be queued for permanent removal.

We may suspend or terminate your account without notice for violation of these Terms, upon request from Discord or law enforcement, or if we determine continued access poses a risk to our infrastructure or other users.

These Terms are governed by the laws applicable to Nexoscale's place of incorporation, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration before being escalated to litigation.
